9.                       However, we are of the view that any such undertaking would not override the above mentioned provision of the brochure. Therefore, the opposite party is bound to pay interest at the bank rate to the complainant on the deposited amount beyond the period of 30 days.

i)            to refund the deposited amount of Rs.70,000/- with interest at the saving bank rate w.e.f. 4.12.2010 (i.e. one month after the draw of lots) till actual payment to the complainant.

ii)          to pay Rs.5,000/- as costs of litigation.
