This revision is directed against the order dated of the State Commission dismissing the first appeal filed by the petitioner for non-prosecution. Learned counsel for the respondent has fairly conceded that -2- in view of the averments made in the revision petition and reason given for non-appearance of the petitioner before the State Commission, the respondent has no objection if the impugned order is set aside and matter is remanded back to the State Commission for disposal of the appeal on merits. In view of the concession given at the Bar and reason given in the revision petition, the order of the State Commission dismissing the appeal in default is set aside and matter is remanded back to the State Commission for disposal of the appeal on merits with request to dispose of the appeal within six months. Parties are directed to appear before the State Commission on 8.8.2013. Revision petition is disposed of.
