Heard Counsel for the petitioner.  There are concurrent findings of two fora below and both the fora below have found that the mistake was on the part of the insurance company itself and the complainant was not at fault.  Pursuant to the said findings, concurrent directions were issued by the two fora below.  We do not find that any case has been made out for interference in the exercise of revisional jurisdiction under Section 21(b) of Consumer Protection Act, 1986 as we do not find any jurisdictional error, illegality or material irregularity in the orders of fora below.  The revision is, accordingly, dismissed with no order as to costs.

 

The insurance company is free to recover the amount from the employee who has made a mistake after giving due opportunity to him.
