ORDER

By Smt. Padmini Sudheesh, President Petitioner’s case is as follows: The petitioner had deposited Rs.70,000/- on 26/4/06 in the respondent Bank. Receipt is issued on that day itself. At the time of depositing the amount there was a condition that on 26/10/2013, the petitioner will be entitled for Rs.1,40,000/- and if he demands before maturity date, at any time the amount will be returned. 2.When the petitioner demanded the money the respondent told that because of the deposit mobilization time, the amount will be returned in the months of March or April. This fact is informed by a letter dated 14/3/07. In spite of repeated demands, the amount is not paid. Lawyer notice sent, no reply, no remedy. Hence the Petition. 3. The notice sent from the Forum is accepted by the respondent on 16/11/07. When the case was called on 21/2/08, the respondents were absent and set exparte. 4. To prove the case of the petitioner he has filed Affidavit and produced 5 documents and marked as Exts. P1 to P5. There is no counter evidence to the evidence of the petitioner 5. Heard the counsel. 6.According to the petitioner he is entitled for the F.D. amount with 18% interest and Rs.10,000/- as compensation and Rs.5000/- as costs. 7. So the petition is allowed and the respondents are directed to return the petitioner the deposited amount of Rs.70,000/- (Rupees Seventy thousand only) with interest @ 18% from 26/4/06 and 6% from today. He is also entitled Rs.500/- as costs. Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open forum this the 30th day of April 2008.
