This order is arising out of the M.A. being No. 46/2018 filed by the complainant in the C. C. No. 232/2017 praying for amendment of the cause title of the complaint petition as mentioned in the schedule below.
It is stated by the complainant in the said M.A. that after hearing summons were sent upon the Ops. After receiving the summon though the Opposite Party No.1 and 2 has appeared before this Ld. Forum and filed their written versions but the summon of the Proforma Opposite Party No.3 has been returned with endorsement “Left”. Thereafter your complainant finds out the new address of the Proforma opposite Party No. 3. Therefore the address of the Proforma Opposite Party No. 3 should be rectified by way of appropriate order of amendment. So it is now necessary to pass appropriate order by amending the complaint petition as has been described in the schedule below otherwise your complainant will suffer irreparable and injures.
The OP-1&2 have received the copy of the said M.A. At the time of hearing the OPs have raised no objection against such application filed by the complainant
We are of the opinion that the amendment as sought for by the complainant is formal in nature and it will not change the nature and character of the complaint. Therefore, the amendment as sought for by the complainant should be allowed. Hence, it is

that the Misc. Application being No. 46/2018 be and the same is allowed on contest without any cost.
Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
