            The cases in C.C.Nos.23/2018 to 33/2018 (both inclusive) are being disposed of  by this common order, the facts of the cases and opponents being common in all cases.  The C.C.No.23/2018 would be taken as the lead case and documents produced by the complainants (copies) would be listed in C.C.No.23/2018only.

2          The cases have been filed before this Forum alleging deficiency of services in the part of the opponents and the averments of the cases are as follows:

            That, the complainants, details of whoms are described underneath had availed crop insurance, for indemnity against natural calamities under the “Pradhan Mantri Fasal Bima Yojana”a modified scheme of the earlier similar ones to raise Soyabean crops in their respective lands in Kharif Fasli year of 2016.  The prescribed premiums were paid to the O.P.no.1 thorugh the O.P.no.2 a financial institution extending agriculture loans and even other wise collecting insurance premiums from loanees and other cultivators.

3.         That, there was crop destruction owing to severe rain fall and flood condition during the month of September in the Fasli year of 2016 and the complainants raised a claim for the insured amount, which was never fulfilled by the O.P.no.1 insurance company for which the present complaints.  It is worth to note here that, in the complaints the crop failure has been attributed to drought conditions departing from the Government issued certificates.  On demand of clarification of the Forum to the complainants’counsel he came forward with the explanation that, his mother tongue and education being in Marathi, the interactions with the complainants were flawed and he had not been able to decipher the Governemnt circular in proper prospective.  Thereby, in the exigency of public and consumer interest, we are constrained to ignore the faux passé of the complainants’counsel and proceed to consider the cases under the dictum of “ex-debito-justitae”and “ignoratia factis excusat”. 

 

4.         Furthering the cases in their right perspective, we observe, in-initio the O.P.no.2 not appearing in spite of notice was placed exparete on 30.07.2018.  On the same day, one Sri.S.Wilson, Advocate filed Vakalath for the O.P.no.1 and had sought time for filing written versions.  Vakalaths   were taken on record and time was granted till 13.08.2018.  On that day, both sides were absent, and extension of time to file versions till 27.08.2018 was granted to the O.P.no.1.  On that day, and till 05.11.2018 both sides were conspicuous for their absence and ultimately the evidence affidavit were filed by the complainants.  Scope was given to O.P.no.1 to file counter affidavit but alas in spite of several adjournments the O.P.no.1 has never raised up to the occasion till 27.02.2019.  On 24.01.2019 however the complainants side has filed written arguments.

5.         With a surprise trend, the counsel for the O.P.No.1 on 27.02.2019 filed an I.A. U/S.151 CPC seeking permission to file versions.  Thereafter there was no representation from either side on 12.03.2019, 23.03.2019, 01.04.2019 to hear arguments on the I.A. and on 16.04.2019, basing on the submission of the complainant to allow the I.A. against cost and also the dicta of the Hon’ble Supreme Court in C.A.No.2017/ D.No.2365/2017 D.O.D. 10.02.2017 we allowed the I.A. of the O.P.no.1 imposing cost of Rs.1000/-payable by 29.04.2019.  We are pained due to the lack lustre attitude of both sided.  Costs having never paid, written versions were expunged from records on 09.05.2019.

On the face of the non opposition, legally, effectively by the O.Ps, there is necessity of determining any points of considerations.  The complainants have proved their cases successfully and therefore we proceed to pass the following:

::ORDERS::

The complaint is allowed in part.

  1.  The O.P.No.1 is hereby directed to pay the insured amount to the complainants without demur along with interest @ 12% p.a. calculated from the date of filing of the complaint till realisation.
  2. Each of the complainant would be paid a compensation of                         Rs. 5,000/- for mental agonies and sufferings by the O.P.no.1.
  3. Litigation expenses of Rs. 2,500/- has to be paid by the O.P.no.1 to the complainants (each).
  4. Four weeks time granted to comply this order.
  5. Original of the order be kept in C.C.No.23/2018 and copies thereof in the connected cases.
