This case has been filed by the complainant u/s 12 of C. P. Act, 1986 praying for an order directing the Opposite Parties to pay the monthly installments of Rs.4000/- per month or to pay the deposited sum of Rs.2,00,000/- to the complainant and also direct the OP to pay interest @15% p. a over the amount of Rs.2,00,000/- and to pay a sum of Rs.25,000/- for compensation and pay a sum of Rs.10,000/- for cost .
From the study of case record, it appears that notices issued against both the Opposite Parties have been returned undelivered. Thereafter, several orders were passed directing the Complainant to take fresh steps upon the Opposite Parties but he is not interested to comply with that order. By filing adjournment petitions date after date, the complainant has been dragging the case. Ultimately, on 09.05.2016 by a petition the complainant expressed his inability to collect the correct address of the Opposite Parties and by an order No. 15 dt. 09.05.16 the complainant was directed to publish the whereabouts of the Opposite Parties in Daily News Papers. But the complainant failed to take such initiative.
In these circumstances, we are of the opinion that the Complainant is not interested to proceed with this case and the case should be dismissed for non-compliance of the Forum’s daily orders.
Hence,
Ordered
that the Consumer Complaint No. 142/2014 be and the same is hereby dismissed for default. There will be no order as to cost.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
