ORDER

          This case has been filed by the Petitioner Ashok Kr. Roy S/o. Late Jagadish Roy, Narayanpur, P.S. Malda, P.O. Old Malda, Dist. Malda.  praying for an order against the O.Ps to restore the electric connection, issuance of correct bill, compensation amounting of Rs.70000/- along with other relieves mentioned in the petition.

          The case of the petitioner is that he is a bona fide consumer of the O.Ps since 17.12.2002 and his Service Connection Number is C/11231 and Consumer No. E520591. He regularly paid the electric bill as per the amount noted in his bill. All on a sudden he received exorbitant bill of Rs. 25886/-. He complained to the Electric Department and thereafter enquiry made by the department by appointing a committee and thereafter, they filed bill amount of Rs. 55878/-. So he filed this case before the Forum and prayed for restoration of electric connection which was disconnected by the O.Ps and correction of bill amount according to his consumption.

          The Electric Department filed W/S denying all the material allegation contenting inter alia that the petitioner consumed electric energy and he did not pay the amount as assessed by the Electric Department. The petitioner has a due of Rs.55878/-.      

          On the basis of the same following issues are framed:-

  1. Whether the case is maintainable?
  2. Whether there is any cause of action to file this case?
  3. Whether there has been any deficiency in service on the part of the ops?
  4. Whether the complainant is entitled to get the relieves as prayed for?

:DECISION WITH REASONS:

          Issue Nos. 1,2,3 and 4

          Petitioner filed some documents which are marked Exts. 1 to 4 and examined himself as a P.W.-1. From the evidence of the petitioner and the petition filed by the petitioner and the O.Ps it is crystal clear that the O.P. already willing in terms of the installments of paying Rs. 55878/- and the P.W.-1 give evidence today that the case has been compromised and he is ready and willing to pay the entire Rs. 55878/- by nine installments i.e. he will pay nine installments i.e. Rs.6000/- in the first installment and the last installment will be Rs.6000/-+ Rs.1878/- = Rs. 7878/- and Electric Department also agreed to restore the electricity of the petitioner when this part is fulfilled and parties are agreed,

Hence, it is                  ordered

that Malda D.F.C. Case No. 19/2014 is disposed of on compromise with the direction that the petitioner will pay Rs. 55878/- by nine installments i.e. Rs.6000/-in the first installments and the last installments will be Rs.6000/-+ Rs.1878/- = Rs. 7878/- without L.P.S.C. and the O.P. No. 2 will restore the electric connection of the petitioner.  

        A copy of this order be given to the parties free of cost.
