ORDER

12-03-2015 – This appeal has been filed alongwith limitation petition.

2.        Heard the parties on limitation and on merits.

3.        On being satisfied with the grounds, the delay of about 32 days in filing this appeal is condoned.

4.        The present complaint was filed alleging that the Electricity Board was charging industrial tariff wrongly instead of commercial tariff but inspite of several reminders, the bills were not rectified and on the threat of disconnection the bills were paid.

5.        According to the Electricity Board, the bills were being correctly raised.

6.        After considering the respective cases of the parties and the materials brought on record by them, in detail, the learned District Forum, interalia held as follows. The Complainant did not disclose as to when the electrical connection was taken and what amount was deposited. He filed the bills only from the year 2009. He also did not make it clear whether his electrical connection was for rural area or urban area or meter was installed or not.

                       Whereas the Case of the Electricity Board was as follows. The complainant took commercial (CS) connection by depositing Rs. 400/- about 6 years, back from 2009 for his shop. He was paying the bills without protest up to 2009. There was dues of more than 10,000/- . He stopped paying bills. His shop was near the industrial area besides the road and he was given commercial connection from urban feeder and therefore the bills were being correctly raised and paid by him as per the meter reading.

 The complaint was dismissed by learned District Forum.

7.        As per the last order, some bills have been filed on behalf of the complainant/appellant which also shows that the bills were raised on commercial tariff and not on industrial tariff as alleged.

8.        After hearing Mr. Pandey and going through the records carefully, we find no merit in this appeal, which is accordingly dismissed.
