- The Complainant being dissatisfied with the commercial attitude of the O.P. filed the complaint for his grand-son Swastk Panda. The Complainant alleged non-refund of Rs. 1200/- towards tution fees and Rs. 1400/- transporting fees. The Complainant raised grievance before District Education officer, Sambalpur and after interference the O.P. granted School leaving certificate of the minor child. Complaint was made before Janasunani portal for refund of money but the O.P. refused to refund. Being aggrieved complaint has been filed.
- The O.P. in reply sub mitted that Complaint is not a consumer as parents of the child Rajalin Mishra(Mother) and Dipak Panda(Father) were taking care of the student as legal guardian. As a third person Complainant is not a consumer. O.P. school is a private school and runs on the fees paid by students Information brochures are being provided to the parents about fees structure and admission. The school is collecting fees on the basis of academic session 1st April to 31st March but for convenience of the parents the schools is collecting fees on monthly basis. Swatik Panda has not paid one month fees for Septemeber, 2023. Computer fees Rs. 1500/- per annum and vehicle fees Rs. 600/- is due. The school has collected Rs. 500/- to-wards issuance of SLC/TC. Rojalin Mishra, mother of the child on 13.03.2024 applied for SLC which was received on 16.03.2024 and SLC issued on 18.03.2024 which was received by his father Dipak Kumar Panda on 20.03.2024.
The Complainant is running a NGO namely “BASSANTA” and regularly harassing the officials and people, threatening to collect information through RTI and abstracting money.
The Complainant filed R.T.I. application before D.E.O. Sambalpur to collect all documents submitted by school for opening permission and COR, detail visit report etc. The Complainant urged for cancellation of COR. In this way taking steps to harass the school management. The Complainant is not entitled for any relief.
- Perused the documents filed by both the parties. From the documents submitted it reveals that Swastik Panda was a student of the O.P. school having school Regd. No. 11/337 for the section 2020-21. Notice has been served by the Complainant through mail of the NGO
Dipak Panda is the father of the Student and Rojalin Mishra, mother who are the natural/legal guardians of the child. The Complainant has no locus standi to file the complaint as a third party without any authorisation. Parents of the child not filed the complaint. Accordingly, this Commission does not feel to go in detail of the Complaint. The Complainant is not a consumer of the O.P., accordingly the Complaint is dismissed.
