                    This is a complaint filed by the above said complainant U/s.12 of the C.P.Act., 1986, against the O.Ps. The sum total of her allegations are as follows:-

 

2.         The complainant is the resident of Bidar and now she is residing at Bangalore.  The complainant claims that, the O.P.s on dated 23/01/2007 had invited applications for allotment of open plots in the approved layout plan located in land bearing Sy.no.8 of Naubad.  Accordingly the complainant had applied for the same, her application number being 189. Thereafter, she had taken part in the auction proceeding and being the highest bidder for plot no.5 measuring 1345 sq. feet, was allotted the same.    After allotment of the said plot, as per BUDA direction, the complainant had deposited total amount of Rs. 3,49,700/- with the O.P.no.1.  After payment of amount the O.Ps. have only made promises to execute the sale deed but, the O.Ps. finally have not executed the sale deed in her favour  as promised.  The complainant had several times requested to the O.Ps to execute the sale deed and the complainant had issued legal notice dt. 27/06/2016 through her counsel but, the O.Ps neither replied the legal  notice nor executed the sale deed of the said plot in favour of her.  The complainant further states that she had borrowed the money  with interest from her relatives and from private money lenders for purchase of the said plot.  Due to negligence and deficiency is of service of the O.Ps. the complainant had sustained loss by giving unnecessary interest on the amount which was borrowed by the complainant from the lenders.  Hence, the complainant prayed this Forum to allow the complaint directing the O.Ps to execute the sale deed as they have received the cost of the plot no.5 measuring 1345 sq.ft. located in land sy.no.8 of Naubad without further delay and O.P. be directed to pay a sum of Rs. 15,00,000/- towards mental tension, loss of interest and cost of the litigation.

 

3.         In the instant case, the O.P.s have only put up appearance through a counsel and have never bothered to file any versions or argue anything contradicting the assertions of the complainant.  Hence, it is proven beyond doubt by the complainant that, the O.P.s inspite of receiving the full consideration amount of the plot No.5 measuring 1345sq.ft. in Sy.No.8 of Naubad, Bidar vide documents Ex.P4, Ex.P5, Ex.P6 and Ex.P7. years back in 2007 have never bothered to execute the Regd. Sale deed and handover the possession of the plot to her, inspite of several representations and legal notice at Ex.P14.  The deficiency of service is glaring at the face of it and without resorting to fix any points of consideration, we hereby pass the following:-

 

:: ORDER ::

   

  The complaint is allowed in part.

 

  1.  The opponents are directed to execute the Regd. Sale deed in respect of plot No.5, measuring 1345 sq. ft, in Sy.No.8 of Naubad village, Tq and Dist- Bidar and put her in physical possession of the same within four weeks from the date of receipt of this order.
  2. Putting her into the dreadful inconveniences for the last about 10 years, the opponent would be liable to compensate her @ Rs.20,000/- per year of default calculating from the date of allotment till compliance of order as in para (a).
  3. The opponents would further pay a sum of Rs.5,000/- towards litigation expenses.
  4. Total compliance within four weeks.
