Order below section 36(2) of Consumer Protection Act 2019 in CC/22/141

Heard Complainant in person. Perused Complaint filed by the complainant and document annexed along with complaint at the stage of admission of complaint below section 36(2) of CPAct.

It has been  observed from the perusal of complaint that , complainant booked a BEST bus without wet lease operated A.C. bus from Lalbaug to Dadar  on 19.5.22  as bus came after one hour  which causing hardship to BEST cutomers due to strike by wet lease drivers  which is deficieny on part of opposite party authority.We have observed that,complainant  have preferred some directions to opposite party and raised some questions.However it  has been observed that complainant has taken ticket from opposite party to travel so complainant is consumer of opposite party but considering averments made by complainant in complaint ,it was necessary on part of complainant to inform opposite party in regard violations committed by them while providing the services to consumers like complainant and ought to have let know standard operations procedures adopted by opposite party.So complainant’s allegations made in complaint remain in air. Considering  mere averments and allegations made in complaint  without substance material against opposite party and provisions of consumer protection Act 2019  present complaint cannot be admitted against opposite parties so  we pass order as follows:

                                            ORDER                                          

1)CC No.22/141 is hereby rejected against opposite parties below section 36(2) of Consumer Protection Act 2019

2)No order as to cost.
