    Nadrai Gate, Kasganj, U.P. presently residing at

    U-12/2, Badshah Nagar, Rajkiya Colony, Lucknow.

2- Smt. Roopa Singh w/o Sri Ram Babu Singh,

    R/o Officers Colony, Nadrai Gate, Kasganj, U.P.

    presently residing at U-12/2, Badshah Nagar,

ORDER

          Ld. Counsel Mr. Alok Kumar Singh appeared for complainants. Ld. Counsel Shri Manvendra Pratap Singh appeared for opposite parties.

          Heard ld. Counsel for parties.

          Opposite parties have admitted that complainants have deposited Rs.6,13,762.00 for booking of flat till 7.11.2013 but construction of flat has not yet been started.

          Ld. Counsel for opposite parties submitted that opposite parties are ready and willing to refund above amount deposited by complainants with interest @ 12.50% p.a. from the date of deposit till date of payment. Ld. Counsel for opposite parties made this offer subject to condition that said amount deposited by complainant alongwith interest @ 12.50% p.a. shall be paid to complainant within 60 days from today.

          Complainant Mr. Ram Babu Singh is present with is counsel. Complainant has accepted above offer made by ld. Counsel for opposite parties and submitted that it should be stipulated that if amount deposited by him is not paid to him within 60 days alongwith interest offered, the rate of interest should be 18% p.a.

          In view of above,  opposite parties are directed to make payment of Rs.6,13,762.00 to complainants within 60 days from today alongwith interest @12.50% p.a. from the date of respective deposit till date of payment, subject to condition that if above amount deposited by complainants alongwith interest at the above rate is not paid by opposite parties within 60 days from today, complainants shall be entitled to get interest @ 18% p.a. on the above amount of Rs. 6,13,762.00 deposited by him from the date of respective deposit till date of payment.

          Complaint is disposed of as above with the consent of both parties.
