This is a complaint filed by the complainant under section 12 of the Consumer Protection Act, praying to pass an order, directing the Ops to pay a compensation of Rs.18,00,000=00 for loss of six years career and cost.
We have heard the arguments of the complainant at the stage of admission; we have gone through the averments of the complaint and relevant documents. On perusal of the complaint, it is made clear that, in the complaint, the complainant has not stated the exact date on which cause of action arose to file the present complaint. The entire complaint is ominous silent, on this material aspect, so also in the complaint, no where it is mentioned for having made correspondence with the OP. In the documents produced on behalf of the complainant, we do not find the copy of the notice issued to the OP. Unless and until¸ the complainant makes correspondence with the OP by writing a letter, he does not get any right to file the present complaint. The complainant is directed to file a fresh complaint, after making correspondence with the Ops. In the result, we proceed to pass the following:
ORDER
The complainant is permitted to withdraw the complaint with liberty to file a fresh complaint after making correspondence with the Ops.
