Case called out several times. None is present on behalf of the complainant.  Learned counsel for the opposite parties is present.

The order sheet indicates that the complainant has not been appearing before this Commission for the last about 8 months. The complainant was granted last opportunity to adduce the evidence on 05.02.2015 as well as on 18.03.2015, but the evidence has not been adduced as yet.

This Commission on 18.03.2015 passed a specific order that in case, if the complainant’s evidence is not filed on the next date fixed, then the matter shall be decided in accordance with law.

However, neither the complainant nor his counsel is present today, nor the evidence has been adduced as yet.

Therefore, we do not have any other option except to dismiss the consumer complaint in default of the complainant.

                        Accordingly, the consumer complaint is dismissed in default of the complainant
