1.                  The instant case was filed by complainant   U/S 12 of the  C.P.  Act, 1986,

as amended against the O.Ps.  alleging deficiency in service U/S 2( 1 )( g ),  2( 1 )( o ) of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the O.P. no. 1  to shift the meter no. 3661935 in a suitable place within the tenanted portion of the petitioner to avoid the apprehension of any accident.  

 

2.                  The o.p. no. 1, CESC Ltd. in the written version stated that the meter

stands in a ruinous condition and their men and agents are facing trouble to read the meter ; that on several dates attempt was made for shifting the electric meter but that could not be done for objection raised by o.p. nos. 2 & 3.    

 

3.                        Upon pleadings of both parties two points arose for determination :

 

i)          Is there any deficiency in service on the part of the O.Ps.  ?

ii)                  Whether the complainant is  entitled to get any relief as prayed for ? 

 

DECISION  WITH   REASONS      :

 

 

5.         Both the points are  taken up together for consideration. It appears that o.p. no. 1 processed the execution job on 16-12-2011 but the work could not be executed for the objection raised by the landlord. If the o.p. has free and clear access to service passage, they have no objection for finishing the job for installation of the same. Therefore, we are of the view that the prayer of the complainant shall be allowed when the o.p. no. 1 has clear intention for installing the meter as prayed for.      

 

     

      Hence,

 

                                    O     R     D      E      R      E        D

 

           

 

      That the C. C. Case No. 39 of 2012 ( HDF 39 of 2012 )  be  allowed on contest but without cost against o.p. no. 1 and dismissed ex parte against the rest but without cost.   

 

      The O.P., CESC Ltd.  be directed to supply electricity to the complainant at premises no. 4/1, K.P. Commar Street, P.O. & P.S. Bally, District – Howrah, through separate meter after compliance of necessary formalities preferably within 30 days from the date of this order.  

 

 

 

     

      If there be any  resistance by anyone including the o.p. nos. 2 & 3  against such supply of electricity in the said premises, CESC Ltd. shall be at liberty to take necessary assistance or protection from P.S. Bally.  The I/C, Bally  P.S. shall be under obligation to provide necessary assistance or protection to the men and officers of the CESC Ltd.  for providing such supply to the complainant in case of approach made by the CESC  Authority.     

       

      Supply the copies of the order to the parties, as per rule.
