The case is taken up for hearing. At the outset the ld. Lawyer for the complainant files a verified application praying for dispose of the case on the ground of amended application dated 08-07-2010 and affidavit dated 24-06-2010. It is submitted on behalf of the complainant that the complainant had already amended the application in pursuance to the written version of the o.p. wherein the complainant is ready and willing to deposit fresh security deposit for his application dated 05-11-1999 and never interested to adjust the amount of Rs. 8,895/- deposited by his father Late Guiram Dey under M.A. Bill No. 06/12270/97/2 dated 29-11-1997 in respect of consumer no. 57135166001 which the complainant undertakes to withdraw in due course of time.
Ld. Lawyer for the o.p., CESC Ltd., has conceded the application of the complainant dated 05-08-2010 and submits that the case may be disposed of in terms of the amended application dated 08-07-2010 and affidavit dated 24-06-2010.
Having heard on both sides and also perusal of the amended application as well as written version and the application filed by the complainant today we find that the matter has been settled in between the parties when the complainant has agreed to the fact that he is interested to have connection on the basis of his own application dated 05-11-1999 upon depositing fresh security amount.
Hence, it is,

That the CESC Ltd. to provide new electric connection to the premises of the complainant at 69/1, Ichapur Road under Bantra P.S. on receipt of the fresh security deposit from the complainant within one month from the date of order the and complainant is also permitted to withdraw the security deposit of Rs. 8,895/- given by his deceased father Late Guiram Dey on 29-11-1997 under M.A. Bill No. 06/12270/97/2 in respect of consumer no. 57135166001.
The application is thus disposed of.
Supply the copy of the order to the parties, free of costs, as per rule.
