On 28-05-2010 the case was heard at length in presence of complainant and o.ps. no. 1 & 2.
O.ps. no. 3, 4 , 5 & 6 were absent on that date and took no step. So the case was heard ex parte against them also.
At the time of hearing ld. Advocate for the complainant submits before us that he applied for new electric connection at holding no. 50, Tripura Roy Lane, P.S. Golabari, District – Howrah, and he is a bonafide occupier of the property also. It is further submitted that they have deposited necessary M.A. bill in connection with the matter of installation of electricity.
On the other hand ld. Advocate appearing on behalf of the o.ps. no. 1 & 2 i.e., CESC Ltd. submitted before us that there is no dispute to provide electric connection with the complainant and they could not do so as the meter board room / position was not accessible. It is further submitted that they are still willing to proceed electric connection to the intending consumer i.e., the complainant if free access is given to them. The o.ps. no. 3, 4 , 5 & 6 did not appear and adverse inference should go against them.
Having heard on both sides and also considering the papers on record enclosed in the petition of complaint we hereby direct the o.ps. no. 1 & 2 i.e., CESC Ltd. shall provide electric connection to the complainant at the premises being no. 50, Tripura Roy Lane, P.S. Golabari, District – Howrah, within 30 days from the date of order and free access is not available the CESC Ltd. shall execute the order with the help of local police authority. The complaint contact with the electricity department regarding installation of electricity at his premises and fixing the date for execution of the order.
The case is thus disposed.
Supply the copy of the order to the contesting parties, free of costs.
