Final Order / Judgement

            This is a complaint made by Md. Asgar, son of Late Md. Nisarat, residing at B-2/21/1/New Tamizuddin Mistry Lane, P.S.-Rabindra Nagar, formerly Metiabruz, Kolkata-700 066 against (1) CESC Ltd., West Subarban Distgrict, P-18, Taratala Road, Kolkata-700 088, OP No.1, (2) District Engineer, CESC Ltd, West Suburban District, P-18, Taratala Road, Kolkata-700 088, OP No.2, and (3) The Dy.Chief Engineer (Distribution), West Suburban District, P-18, Taratalla Road, Kolkata-700 088, OP No.3, praying for direction upon the OPs to supply electric connection at the scheduled premises and further direction for compensation of Rs.50,000/- and litigation cost of Rs.10,000/-.

            Facts in brief are that Complainant is the owner in respect of the premises No.B-2/21/1/New Tamizuddin Mistry Lane, P.S.-Rabindra Nagar, Kolkata-700 066. OPs are officers holding the posts in CESC.

            Complainant applied for new connection of electricity at his premises to OP No.1 and MASD bill was raised which the Complainant paid. Thereafter, OPs assured to supply electric connection. But they did not supply. This is deficiency in service and so complainant filed this complaint.

            CESC filed written version and denied all the allegations of the complaint. Further, CESC has stated that if this Forum orders, they are ready and willing to supply electric connection.

Decision with reasons

            Complainant filed affidavit-in-chief wherein he has reiterated the facts mentioned in the complaint petition.

            Main point for determination is whether Complainant is entitled to the reliefs as prayed for.

            In order to substantiate the allegations made in the complaint petition, Complainant has filed Xerox copies of deed of purchase. Complainant has also filed copy of MASD bill and also one tax-paying receipt issued from Maheshtala Municipality. These documents substantiate the allegation of the complaint.

            As such, it appears that OPs are liable to supply the electric connection to the Complainant at the premises mentioned in the schedule.

            Hence,

ordered

            CC/338/2016 and the same is considered and is allowed in part. OPs are directed to install electric connection as per rules within two months of this order.
