The petition of complaint has been filed by complainant Chira Ranjan Das against the o.p. CED, CMRI. The case of the complainant in short is that complainant that his wife Smt. Bijan Rani Das was admitted in CMRI on 18.6.11 and discharged on 26.6.11 and four tests report were pending at the time of his wife’s discharge and complainants was told to collect later and those reports were not given to complainant and complainant had been to o.p. on 26.7.11 to collect reports but get only two reports and complainant had been to o.p. on 20.8.11 and get only one report. The remaining report of LDH ISO Enzyme cost of Rs.1500/- could not be given even waiting there for a couple of hours and he requested in writing to send the report through courier in his address and surprisingly enough the report was dispatched from the pathology department to the word on 25.6.11 prior to the date of release of his wife and doctor did not look for it. That is why the instant case has been filed by complainant for harassing as against o.p. being serviced provider to its consumer / complainant. Complainant made thorough persuasion but without any fruitful result. Hence the case.
O.p. did not turn up in this case and matter was heard ex parte as against o.p. accordingly.
Decision with reasons:-
We have gone through the pleadings of the parties, evidence and documents in particular and considered the submission of complainant and on perusal of the entire materials on record we are of the view that complainant has sufficient grievance as against o.p. and o.p. had profuse negligency being service provider to its consumer / complainant and this is not expected from a hospital like CMRI and complainant is entitled to relief.
The evidenced of complainant remains unchallenged testimony since o.p. did not come forward to rebut the same despite receipt of notice.
Hence, ordered,
That the petition of complaint is allowed ex parte with cost against o.p. O.p. is directed to pay to the complainant compensation of Rs.75,000/- (Rupees seventy five thousand) only for his harassment and mental agony and litigation cost of Rs.10,000/- (Rupees ten thousand) only within 45 days from the date of communication of this order, i.d. interest @ 9% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.
Supply free certified copy of this order to the parties as per section 21(1) of the Consumer Protection Regulation.
