            The complaint is filed for return of R.C. Book NOC and connected records of two wheeler bearing Reg.No.KL2Q-3356 and for compensation and cost.

 

          The averments in the complaint can be briefly summarized as follows:

 

                   The complainant availed loan from the opp.party and purchased a two wheeler TVS bearing Reg.No.KL2 Q 3356.  The complainant has paid the entire instalmeents though his acknowledgement  in the Federal Bank, Kureepally Branch.   The opp.party refused to return the RC Book and other documents  and to issue NOC.   The act of opp.party is deficiency in service.   Hence the complaint is filed for getting relief.

 

          Even though sufficient opportunities has been given to the opp.party they wer not ready to attend the Forum and adduced evidence.

The complainant filed affidavit ,  PW.1 was examined.   The statement of accounts of complainant from the Federal Bank, Kureeppally is marked as Ext.P1 series.

The points that would arise for consideration are:

1.     Whether there is any deficiency in service on the part of opp.party.

2.     Compensation and cost.

As the opp.party did not adduced any evidence.   We are constrained to relay upon the evidence adduced by the complainant.  On perusal of documents we find that there is deficiency in service on the part of opp.party.

Hence the complaint is allowed.   The opp.party directed to return the RC Book and other related documents of the two wheeler bearing Reg.No.KLQ 3356 and to issue No Objection Certificate to the complainant.   The opp.party is also directed to pay Rs.2000/- as compensation and Rs.750/- towards cost to the complainant.   The order is to be complied with within one month from the date of receipt of the order.
