Heard the parties. Perused the material available on record. We have given our thoughtful consideration to the respective contention of the parties. As per Sec.38(6) of the C.P.Act,2019 every complaint is to be heard by the District Commission on the basis of affidavit and documentary evidence placed on record. Here in this case the averment of the complaint petition is not supported by any affidavit so also photocopy of document filed are not attested to be true in any manner as such can not be taken as  evidence. Law is well settled that complainant is to prove the deficiency in service on the part of the Ops. But he has not adduced any evidence to substantiate his claim. For the above reason it can not be concluded that there is any deficiency in service on the part of the Ops. Hence, complaint against the Ops is dismissed on contest. However no order as to cost. Copy of this order be served to the parities free of cost for their perusal and up load the order in the website of this Commission.
