DHr called out absent.  Despite service of showcause notice, DHr remained absent and failed to submit his explanation for the showcause notice served upon him.  The DHr took notice of Execution Petition to Central Seat Allocation Board (CSAB) & JEE (Mains) though the said institution is neither a party to the complaint nor to the Execution Petition, thereby made the official of the said institution to come over to Forum all the way from Patna in the state of Bihar along with a Advocate resulting in huge expenses and inconvenience to the said institution.  In the past also DHr took notice against JDr No.2 (OP-2) though the complaint as against JDr No.2 was dismissed thereby causing great inconvenience to the JDr No.2 for which he was imposed with cost of Rs.500/-.

        From the conduct of DHr, we are of the opinion that instead of taking notice to the JDr against whom the order has been passed he is taking notice to other parties thereby causing hardship and inconvenience to the said parties and wasting precious time of the court.  The DHr has failed to take steps to JDr on record, despite sufficient time and opportunity given. Therefore, Execution Petition is dismissed for non-prosecution.
