Brief Facts of the case
Complainant had saving bank account with OP annexed copy of bank account marked as CW1/1. Complainant tried to withdraw a sum of Rs 10,000/-from OP’s ATM on dated 28/02/201 at about 4.30 pm. It was alleged that soon after the withdrawal formalities were completed, he did not get the money, whereas he had a balance of Rs 16,392/. He again tried to withdraw Rs 500/-which were received by him and got statement of account showing balance Rs 15,892/. Thereafter, he tried again to withdraw Rs 10,000/-, but no transaction was done. He, then went to another ATM of State Bank of Bikaner situated nearby to his house and tried to withdraw Rs 5000/- which were received by him, annexed here his bank account detail as CW1/2. Thereafter, he lodged complaint with OP on 03/03/2014 marked here as CW1/4 & 5. OP assured to check and refund the amount of Rs 10,000/- after checking the ATM data.
Complainant got reply of his complaint on dated 21/04/2014 where OP declined to refund Rs 10,000/- in his account as stated that the transaction was successful, marked here CW1/3. Thereafter, complainant sent a legal notice for deficiency in service of OP on 28/04/2014marked here as CW1/6. When he did not get the reply, filed this complaint claiming refund of Rs 10,000/- in his account with Rs 50,000/- for harassment and mental agony and litigation charges Rs 11,000/-.
Notice was served. OP submitted written statement and denied all the allegations of deficiency in their services. OP state that as per their internal data of ATM showed no extra cash and the said transaction of Rs 10,000/-vide transaction no. 6593 in ATM ID F30N349501 located at Kanti Nagar, East Delhi, was successful as shown as triple zero (000) marked here as Annexure 1. OP stated that the complainant had lodged a false complaint and so be dismissed.
Complainant and OP filed their evidences on affidavit and were on record. Arguments heard and order was reserved.
We perused the facts and evidences submitted by complainant which were on record, it was clear that complainant made attempt to withdraw money, but money did not receive. By perusing the evidence of transaction, it showed that transaction was successful with triple zero code.
So, we are of the opinion that complaint has no merit and the same deserve to be dismissed, so dismissed without cost.
The copy of this order be sent to the parties as per rules and file be consigned to the record room.
