20-10-2023 Present : Sh.Jaskaran Singh, counsel for the complainant

 

This order shall dispose of present complaint after affording preliminary hearing to the counsel for the complainant.

During preliminary hearing, counsel for the complainant has argued that Golo Kaur daughter of the complainant obtained the policy of Pradhan Mantri Jeevan Jyoti Bima Yojana (PMJJBY) of opposite party No.3 from opposite party No.1 for Rs.2 lakhs. Golo Kaur died on 12.6.2021. After her death, the complainant became entitled for the insurance claim from opposite parties under PMJJBY being the mother and nominee. Complainant lodged claim with opposite parties, but they have failed to settle the claim till date. The complainant suffered from grave mental tension, agony, harassment and humiliation.

We have heard learned counsel for the complainant and gone through the record.

A perusal of file shows that complainant lodged insurance claim with the opposite parties but the opposite parties have neither repudiated nor approved the claim of the complainant till date. Therefore, this Commission is of the view that complaint is pre-mature at this stage. As such, without going into merits of the case, opposite parties are directed to settle the claim of the complainant within 45 days from the date of receipt of copy of this order. As such, this complaint stands disposed off.

Copy of order be issued to complainant and opposite parties free of cost and file be consigned to record room.
