Brief Facts of the case
Complainant was having a saving bank account in OP bank vide saving account no. 3313807429 with OP. He had also a credit card no. 5196084104022758 issued from OP bank.
Complainant withdrawn sum of S 15,000/- on 09/03/2014 vide transaction ID 547476. He again withdrawn Rs 10,000/- and his both transactions were successful. His next transaction of sum of 15,000/- were not successful vide transaction ID 548193, so he made a complaint to branch manager of OP who assured for revertal of same amount in his account in 48 hours. When he did not get any satisfactory response from OP, s filed this complaint claiming revertal of Rs 15000/- with physical harassment and compensation of Rs 30,000/-.
After scrutinizing complaint, notice was served. But OP did not put up their appearance nor submitted written statement and evidence. After giving ample opportunities for appearance, case proceeded Ex Parte. Complainant submitted evidences on affidavit and were on record. Arguments were heard. Order was reserved.
We perused the facts and evidences submitted by complainant which were on record, it was clear that complainant made three withdrawal as per three mini statement slips on record and a OP bank’s transaction detail which confirms that amount was withdrawn from complainant account. But he had not submitted any concrete evidence which can prove deficiency of OP bank by lodging police report and OP bank’s remark. His saving bank account details confirms that money was withdrawn. By seeing the transaction details, it cannot be said that withdrawal was unsuccessful or not withdrawn by complainant.
Hence, we come to conclusion that deficiency of OP has not been proved by complainant, so this complaint deserves dismissal. Complaint dismissed.
