Complaint presented today. It be checked and registered.
The complainant has filed the present complaint under Section 35 of the Consumer Protection Act, 2019 against the opposite party (hereinafter referred to as (OP) on the averments that the complainant is retired as PTI from Education Department and is having saving pension bank account no.1956567293 in the Branch of the OP. The complainant had not availed the loan from the OP. The loan availed by Roshan, who is recorded as the owner of agricultural land situated at village Rahara, Tehsil Assandh, District Karnal in Khewat No.495/459 vide jamabandhi for the year 2017-2018 and the land of said Roshan has been attached by the bank for recovery. OP has freezed the account of the complainant illegally and without affording any opportunity of hearing to the complainant. The complainant and his family depends on the pension amount. The OP has refused to de-freezed the account of the complainant. Hence, this complaint.
Argument on point of admissibility heard.
The complainant had stood surety of loan availed by Roshan, who failed to repay the loan amount. In the present complaint has concealed the material facts with regard to surety/guarantor of said Roshan. Complainant is liable to pay the out-standing loan amount of said Roshan on being defaulter of said loan.
Hence, in view of above, the present complaint is devoid of merits and deserves to be dismissed and same is hereby dismissed. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
