The complainant has filed the present complaint against the O.P u/sec. 12 of Consumer Protection Act, 1986. The brief facts as alleged in the complaint are that the complainant is having saving bank account No.3324635932 with the Central Bank of India, Mori Gate Branch, New Delhi.  It is further stated in the complaint that on 13.09.2014 the complainant processed his ATM Card for withdrawal of Rs.10,000/- from the ATM of Indian Overseas Bank but the ATM did not dispense with the cash but an amount i.e. Rs.10,000/- was debited from his saving account.  He has prayed for return of the said amount.

2.     Notice of the complaint was issued to the Central Bank Branch which appeared and filed its written statement and evidence.  It will be relevant to note that Indian Overseas Bank has not been arrayed respondent; therefore no notice was issued to it.  OP has filed various documents and also JP LOG and switch report which show that on 13.9.2014 vide ATM Card No.4622444078324647 a sum of Rs.10,000/-was withdrawn and the transaction was successful. On the basis of electronically generated record, it is proved that the transaction of withdrawal was successfully made by the ATM cardholder i.e the complainant.  The complaint is devoid of any merit and hence dismissed.  Ordered accordingly.

Copy of the order be sent to the parties as per rules.
