Learned advocate for the appellant (original complainant) stated that in view of Para 4 of the impugned order the complainant is willing to furnish all particulars, which are necessary for the Forum to decide the controversy such as when the loan was taken, how much loan was taken and how it was repaid as also particulars regarding title deed, which are in possession of the bank and certificate in respect of total repayment of the loan.

This being the submission, we are inclined to remand this matter to the District Consumer Forum, Akola to allow the appellant (original complainant) to produce all necessary particulars as stated above and then to decide the complaint on merits according to law.

ORDER

i.        The appeal is allowed accordingly.

ii.       The impugned order is set aside.

iii.      The Forum below shall decide the complaint afresh in accordance with law.

iv.      Both parties shall remain present before District Consumer Forum, Amravati on 21.09.2016 at 10.30 a.m.

vi.      Copy of the order be furnished to both parties free of cost.

v.       Copy of the order also be furnished to the Forum below.
