ORDER

Shri M. L. Gupta, learned counsel for the appellant.           

               Heard on admission.

               This appeal has been filed by the complainant against the order dated 09.07.2015 passed by the District Forum, Datia in C.C.No.29/2014.

                After hearing learned counsel for the appellant and on going through the record we find that the complainant-appellant has filed a complaint against the respondents alleging deficiency in service in seizing the tractor which he purchased after getting finance from the respondent bank. The respondent resisted the complaint stating that the appellant was defaulter in paying the instalments therefore the tractor was seized.

                 The District Forum after appreciation of evidence on record has allowed the complaint with a direction to opposite parties to give detailed statement regarding dues and payments made and also to return the tractor to the appellant.  The District Forum has also ordered for compensation of Rs.10,000/-. We find that the grievance of the complainant-appellant has been redressed properly and the appellant has been adequately compensated.  However, the appellant has filed execution before the District Forum and since the Presiding Officer of the Forum has been transferred and the execution is pending, he moved a transfer application before this Commission as Transfer

Application No. 11/2015 in which on 10.08.2015 after giving notice to the respondent it has been directed to respondent bank that the bank shall not auction the tractor of the appellant until further orders.  We fail to understand what more the appellant wants.  He may proceed in execution proceedings before the District Forum.

              We do not find any infirmity or adversity in the order passed by the District Forum.  The order of the District Forum is affirmed. The appeal is therefore dismissed summarily at the admission stage.
