Complainant files hazira.  OP Nos.1 & 2 also file hazira.

This case is fixed today for settlement in view of the application of the OP No.2 filed on 12.10.2017. 

Today the complainant has filed an application stating that OP No.2 has paid the settlement amount of Rs.15,000/- to the complainant by way of a cheque vide cheque No.000882 dated 21.11.2017 as full and final settlement of this case and the complainant has handed over the mobile phone along with accessories to the OP No.2 and in view of such settlement the complainant prays for withdrawal of the case as he shall not have any claim whatsoever in future regarding the matter in dispute.  Copy served upon the OP No.2.

Complainant files money receipt and the Xerox copy of the cheque. 

The OP No.2 also files refund acknowledgement dated 21.11.2017 and a receipt regarding receiving of mobile phone.

Heard the ld. advocate of both sides. 

Perused the application and the documents submitted by the parties.  Considered.  Prayer is allowed.

Hence, it is

                      O R D E R E D

that the complainant is allowed to withdraw the case with a direction not to file any fresh case with self same cause of action against the OPs. 

The case is disposed of accordingly.
