-: ORDER:-

 

This complaint is filed seeking direction to the Opposite Party to give “No Due Certificate” and to pay compensation of Rs.60,000/-, making certain allegations along with documents.

2.       The opposite party though served remained absent.  Hence the complainant has stated that his complaint and documents be read as his evidence.  Hence the matter is heard.

 

3.       The points that arise for our consideration are:-

  1. Whether there is any deficiency in service on the part of the opposite party?
  2. What Order?

 

4.       Our findings are:-

5.       Reading the pleading in conjunction with the documents on record, it is established that the complainant is a credit card holder of the opposite party bearing No.4541-9827-0606-0305 and regarding that the opposite party has issued a statement demanding Rs.26,426/- in June-2011.  This has been paid by the complainant on 04.06.2011 and sought closure of the credit card and closure of the account and issue of “No Due Certificate” to him.  This the opposite party has failed.

 

6.       When the entire amount claimed is paid and sought cancellation of the credit card the opposite party was bound to issue “No Due Certificate” and also close the credit card account, but they have not done.  This is nothing but deficiency in service.  Hence we hold the above points accordingly and proceed to pass the following:-

 

 

 

 

 

-: ORDER:-

  1. The Complaint is Allowed-in-part.
  2. The opposite party is directed to issue “No Due Certificate” to the complainant with respect to the credit card bearing No.4541-9827-0606-0305 of the complainant within 30 days from the date of this order.
  3. The complainant shall tear the credit card in to four pieces and send it to the opposite party within one week from the date of this order.
  4. The opposite party is also directed to pay Rs.5,000/- as compensation to the complainant.
  5. The opposite party is directed to pay Rs.2,000/- to the complainant towards costs of this litigation.
  6. Return the extra sets filed by the parties to the concerned as under Regulation 20(3) of the Consumer’s Protection Regulation 2005.
  7. Send a copy of this order to both parties free of costs, immediately.
