Sri. Manulal V.S, President

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration. After hearing the matter the Commission passed an order as follows:

This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties.  After admitting the complaint notice was issued to the opposite party and the same was returned unserved.  Since 28/12/2023 this case was posted for taking steps by the  complainant against the opposite party.

When the case came up for consideration today, it is noticed that the complainant was continuously absent since 28/12/2023 and not taken any steps against the opposite party, inspite of giving sufficient opportunities for the same. The notice issued to the complainant on 6-2-2024 returned as addresse not known.  In the above circumstances we find that the complainant is not interested to further proceed with this complaint.  In view of the above discussion we find that this is a fit case to be dismissed for default.

In the result the complaint is dismissed.  There will be no order as to cost.

Pronounced in the Open Commission on this the 30th day of April, 2024
