         Succinctly put, the Complainant approached the OPs for a student visa to Canada and paid a sum of Rs.10,000/-. The original documents were also handed over to the OPs. Thereafter, offer of admission and the acceptance form on the letter head of Mohawk College was issued to the Complainant. It was alleged that the said offer of admission was not signed by any person or authority, upon which the Complainant approached the OPs a number of times, but to no avail. Smelling something fishy, the mother of the complainant addressed a communication to Mohawk College with regard to the genuineness of the offer of admission letter for January 4, 2011 and in response to which it was replied vide Annexure C-5 that they had bad experience with Careers Overseas agents.   Ultimately, a legal notice dated 14.12.2010 was served upon the OPs, but the same failed to fetch the desired results. Hence this complaint, alleging that the aforesaid acts of the OP amount to deficiency in service and unfair trade practice.
2.       OPs refused to accept the service of summons and as such, proceeded against exparte.
3.       The Complainant visited the OPs for a student visa to Canada and paid a sum of Rs.10,000/-. The complainant also handed over some original documents to the OP. That e-mail was sent to Mohawk College to confirm the authenticity of the matter. A legal notice dated 14.12.2010 was also served upon the OPs but all in vain. The complainant supports the averments made in the complainant vide his affidavit dated 08.02.2011. The receipt (Annexure C-1) qua which the documents had been received from the complainant along with the cheque of Rs.10000/- for applying student visa to Canada has been placed on record. Annexure C-2 is the copy of offer of admission and Annexure C-3 is the acceptance form. The mother of the complainant addressed a communication to Mohawk College with regard to the genuineness of the offer of admission letter for January 4, 2011 which was replied vide Annexure C-5 stating therein that they had bad experience with Careers Overseas agents.
4.       Admittedly, the OP despite service did not care to contest the case and as such it can be concluded without any hesitation that either the OP admits the claim of the complainant or has nothing to say in the matter. Moreover, the evidence led by the complainant has also gone un-rebutted and uncontroverted. Otherwise also, the OPs have failed to arrange a student visa to Canada for the complainant despite his repeated requests which amounts to deficiency in service on their part.  
5.       As a result of the above discussion, this complaint is accepted and OPs are directed to refund Rs.10,000/- to the complainant along with interest @ 9% p.a. from the date of its deposit till realization along with Rs.2500/- as compensation for mental agony and harassment and Rs.5000/- as costs of litigation within one month from the date of receipt of the certified copy.
6.       Certified copies of this order be sent to the parties free of charge. The file be consigned.
