Hazira is filed on behalf of the complainant through advocate.

No step is taken by the O.P.

The case is fixed for filing W.V. I/D Ex-Parte hearing.

It appears from the record that the case is being adjourned from time to time for filing W.V. by the O.P. but no W.V. has been filed yet and so in view of the conditional order the record is taken up for Ex-Parte hearing.

The complainant deposited Rs.5,000/- with the O.P. on 02-11-2017 under receipt issued by the O.P. for admission to Nursing Training in O.P.’s establishment but the complainant came to learn that the establishment of O.P. is not duly registered and affiliated and so the complainant requested the O.P. for return of the said deposit which was flatly refused by the O.P.

Perused the petition of complaint and the documents filed therewith.

Heard the Ld Advocate for the complainant. The complainant deposited Admission fee of Rs.5,000/- with the O.P. as is evident from the Money receipt but she did not take any admission in the O.P.’s establishment and so she is entitled to get refund of the deposit of Rs.5,000/- from the O.P.

Prima-facie case of the complainant is established and the complainant is entitled to get the refund as prayed for.

Hence it is ordered………

That the case is allowed Ex-parte against the O.P.

O.P. is directed to refund Rs.5,000/- to the complainant within one month from this date I/D she may recover the same through execution process.

Both parties be supplied copy of this Judgement free of cost.
