COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019.

Present:-      Shri Ashok Kumar, Advocate, Counsel for the Complainant.

                     Shri Atul Goyal, Advocate, Counsel for OP No.2.

 

                     Today the case is fixed for appearance of OP No. 1 as well as filing written statement by the OP No.2. Ld. Counsel for OP No.2 filed written statement alongwith power of attorney and also moved an application seeking dismissal of the present Complaint under order VII Rule 11(a). Copy given.

                     On the other hand, the Ld. Counsel for the Complainant by making a separate statement stated that due to some technical reasons, he seeks permission to withdraw the present complaint with liberty to file afresh before the Competent Commission.

                     Heard. In view of the statement made by the Ld. Counsel for the  Complainant, the present complaint is hereby dismissed as withdrawn, with liberty to file it afresh before the Competent Court/Commission, if he so wishes or is advised.

                     A copy of this order be sent to the parties, free of costs and File be consigned to record room after due compliance.
