File taken up today, i.e. on 14.09.2024 in the National Lok Adalat. Statement of Sh.R.K.Sharma, Adv. Counsel for OPs No.1 & 2 recorded to the effect that Insurance Company/OPs No.1& 2 are ready to compromise, the claims of the complainant and the present complaint, for 20,000 USD converted in Indian rupees at the prevelant rate of USD as on date of death i.e. 07.12.2021 as full & final settlement of the claim of the complainant. The compromise amount shall be paid within 45 days from the date of passing of award. The compromise award may be passed accordingly.

Sh.Pankaj Kumar, Adv. Counsel for the Complainant has made a statement to the effect that he has accepted the offered amount regrading the claim of the complainant, 20,000 USD converted in Indian rupees.

In view of statement suffered by Ld. Counsel for both the parties and considering the facts that the good sense has prevailed upon the parties and they have settled the matter amicably. So accordingly, the award is passed with the direction to the OPs No.1 & 2, to pay the amount of 20,000 USD, converted in Indian rupees at the prevalent rate of USD as on date of death i.e. 07.12.2021, within a period of 45 days from the date of the passing the award, failing which the OPs will be liable to pay interest @ 9% per annum to the complainant from the date of filing of complaint till realisation.. The present complaint is accordingly disposed of. Copy of the award be supplied to the parties, free of costs, as per rules. File be consigned to the record room.
