ORDER:
Today the case was fixed for filing written statement on behalf
of opposite parties Nos.1 to 3.
Shri Bharat Garg, counsel for opposite parties Nos.1 & 2 i.e. M/s. Care Health Insurance Limited has made a statement that compromise has been effected between both the parties. As per compromise, company is ready to pay an amount of Rs.60,000/- as full and final settlement towards the claim of complainant. Award may be passed accordingly.
Shri Deepak Sharma, counsel for the complainant has made a statement that “I accept the offer given by opposite parties Nos.1 & 2 and ready to accept the payment of Rs.60,000/- offered made by the insurance company as full and final settlement towards the claim of the complainant Sh. Vishal Gupta. Award may be passed accordingly.”
On the basis of the statement of both the parties, the Commission is of the opinion that the complaint is disposed off with the direction to opposite parties Nos.1 & 2 to pay Rs.60,000/- as full and final settlement towards the claim of the complainant Shri Vishal Gupta. The opposite parties Nos.1 & 2 are also directed
to pay Rs.5500/- as compensation on account of mental tension, agony and harassment alongwith Rs.5500/- as litigation expenses to the complainant. Compliance of this order be made within 30 days from the date of receipt of copy of order. Copy of this order be given to the parties concerned free of costs and file be consigned to record room.
