ORDER:
Today the case is fixed for consideration on the point of admissibility.
2. The complainant has filed the present complaint u/s 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as ‘OPs’) on the averments that complainant purchased a health insurance policy which covers, complainant, his wife, one daughter and mother Ram Devi. Suddenly Sudesh Devi wife of complainant suddenly suffered from heart problem and she was taken to NP Rawal Hospital, Karnal and remained admitted as indoor patient and the complainant spent Rs.1,00,000/- approximately. After discharge, the complainant submitted the bills for reimbursement but despite repeated requests, the claim of the complainant was not reimbursed. Finding no other alternative, the complainant has filed the present complaint.
3. None has put in appearance on behalf of complainant from the last two dates.
4. As per Section 36 of the Consumer Protection Act, 2019, the admissibility of the complaint is ordinarily be decided within twenty-one days from the date on which the complaint was filed. The present complaint has been filed on 14.12.2023 and twenty one days is going to be expired but none has appeared on behalf of complainant. The working of Judicial Courts are closed till 01.01.2024 due to winter vacation and during winter vacation most of the advocates do not come in the Court. If the case is adjourns, then the position will remain same. Furthermore, in the complaint there are so much clerical mistakes. The complainant has many places mentioned the word “you addressee”, which means the counsel has not checked the complaint after drafting and filed in a very casual way.
5. Thus, in view of the above discussion, the present complaint deserves to be dismissed and same is hereby dismissed in limine. No order as to costs. However, the complainant is at liberty to file fresh complaint after removing the defects before the competent court of law. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
