Learned Counsel for the Complainant/Petitioner has filed a Memo praying for withdrawal of the complaint petition with a liberty to file the case before the District Consumer Disputes Redressal Commission.

          Memo be kept in record.

          We have heard learned counsel Mr. K.K.Jena  appearing on behalf of the Complainant/Petitioner.

          Taking into consideration the  memo filed on behalf of Complainant, we allow the Complainant/Petitioner to withdraw the present Consumer Complaint from this State Commission with a liberty to file the Consumer Complaint before  the appropriate District Consumer Commission within one month  from the date of receipt of  this Order.

           We make it clear that if the Complainant files the consumer complaint within 30 days of receipt of this order before the learned District 

 

Consumer Disputes Redressal Commission then learned District Commission  shall do well to dispose of the complaint case within a period of three months from the date of receipt of notice by Opposite Parties giving due opportunity to OPs to file their respective versions, evidence on affidavit and giving opportunity of hearing to all the Parties.

            Hence the present appeal is dismissed as withdrawn.
