1. This order shall dispose off an application “U/o Rule 9 read with section 151 CPC” filed on behalf of Complainant for restoration of the complaint. We have heard the Ld. Counsel for the Complainant and we have also perused the file. The case of the Applicant is that on the faithful day the Counsel for the Complainant was out of Delhi due to family problem and on this account the Counsel did not appear and the case was dismissed. The perusal of the file shows that the case was listed on 13.09.2023 and adjournment was sought by the Proxy Counsel for the Complainant. The matter was adjourned for 18.09.2023 and on 18.09.2023 none has appeared and the matter was adjourned for admission hearing on 21.09.2023. On the said date i.e. 21.09.2023 none has appeared on behalf of the Complainant and the matter was adjourned for 26.09.2023. Again on 26.09.2023, none has appeared on behalf of the Complainant and the matter was dismissed for non-prosecution. The perusal of the file shows that none has appeared for the Complainant for three consecutive dates. No reason has been assigned for non-appearance on the three consecutive dates. It is further to be noted that the application is not signed by the Complainant nor it is supported by the affidavit of the Complainant or affidavit of the advocate of the Complainant.
2. In view of the above discussion, we do not see any merit in the application and the same is dismissed.
3. Order announced on 27.10.2023.

Copy of this order be given to the Complainant at free of cost
