ORDER BY HON’BLE MEMBER- MRS. M. SWAIN:

                                                                                                 JUDGMENT

             Complainant being the successful bidder in pursuance of e-auction notice dated 07.11.2022 published in the business standard and The Samaj took part in the bidding process and auction holder successful deposited Rs.32,90,000/- on 25.01.2023 but opposite parties have failed to deliver the possession of the land to the complainant but only sale certificate has been issued.

            Case is admitted and notice to opposite parties was sent by Regd. Post but the opposite parties did not appear and set ex-parte on 15.5.2024.

            Since the opposite parties have failed to deliver the physical possession, it is not just and proper to return the money deposited by the complainant and it amounts to the deficiency in service as defined U/s.2(7) (b) of Consumer Protection Act, 2019.

            We therefore direct the opposite parties to refund the deposited amount with S.B. Account rate of interest from the date of deposit till date of payment within period of 45 days from the date of receipt of the order. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.

            Pronounced in the open Commission on this 9th August,2024.
