The matter was passed over. On the second call also none is present on behalf of the petitioner. This petition came up for hearing for the first time on 21.11.2011. Since, the petition was defective, notice was sent to the petitioner to remove the defects. Thereafter, counsel for the petitioner had appeared on two dates and sought time for removing the defects. Till date, the defects have not been removed. On the last date of hearing, i.e., 9.5.2012 none was present on behalf of the petitioner. Consequently, notice was sent to the petitioner as well as counsel. Notice issued to petitioner has been received back with postal remarks nsufficient address whereas notice to counsel for the petitioner was duly served. Since nobody has been appearing on behalf of petitioner for last three consecutive dates, nor the defects pointed out by the Registry have been removed, the petition stands dismissed in default.
