Complainant absent. Opposite party represented and submitted that complainant was continuously absent and was trying to evade from cross examination by them and opposite party lost their chance to prove their case. As per Section 114 III (g) if a party abstains from entering into the witness Box an adverse inference would arise against him AIR 1999SC.1441. Hon’ble Supreme Court held that “ Where a party to the suit does not appear into the witness box and states his own case on oath does not offer himself to be cross examined by the other side or presumption would arise that the case set up by him is not correct” Hence the petition is dismissed.
