The Complainant has filed the present complaint under Section 35 of the Consumer Protection Act, 2019.

Case of the Complainant

  1. The case of the Complainant as revealed from the record is that the Complainant is having a saving bank account in Canara Bank i.e. Opposite Party bearing a/c no. 197411015605. It is his case that Complainant asked the bank manager of Opposite Party to close the said account because the said account is currently in minus. When he asked the bank manager that why his account is in minus then bank manager told the Complainant that Complainant had taken loan from various other sources and Complainant did not pay the EMIs therefore Complainant’s account was going to minus. As per the Complainant, he paid the entire loan and EMIs to those from whom he had taken the loan. Complainant stated that there was no loan and EMIs of any company is pending against the Complainant. Complainant stated that the bank manager of the Opposite Party was not responding the request of the Complainant to close the said bank account. Complainant stated that he asked for the passbook and bar code but bank manager of Opposite Party refused the same. Complainant has prayed to direct the Opposite Party to close the said account and to pay an amount of Rs. 50,000/- on account of mental harassment.
  2. None has appeared on behalf of the Opposite Party despite service of notice to contest the case. Therefore, Opposite Party was proceeded against ex-parte vide order dated 06.12.2022

  1. The Complainant in support of his case filed his affidavit wherein he has supported the assertions made in the complaint.

 

Arguments & Conclusion

  1. We have heard the Complainant and we have also perused the file. The averments made by the Complainant in the complaint are supported by his affidavit and documents filed by him. The Opposite Party did not appear and did not file any written statement. Therefore, the averments made in the complaint are to be believed.
  2. In view of the above discussion, the complaint is allowed. Opposite Party is directed to close the account of the Complainant bearing account no. 197411015605. Opposite Party is also directed to pay an amount of Rs. 10,000/- to the Complainant on account of mental harassment along with interest @ 6 % p.a. from the date of this order till recovery.
  3. Order announced on 13.09.2023.

Copy of this order be given to the parties free of cost
