The complainant has filed the present complaint against the O.P under section 12 of Consumer Protection Act, 1986. The brief facts as stated by the complainant are that he retired from the Govt. of NCT of Delhi as Naib-Tehsildar on 31.05.2011bearing PPO No. 676691100585. The complainant alleged that the pension was revised by PAO on 21.09.2017 and sent to the Central Pension Accounting Office, Govt. of Trikoot-2 Bikaji Cama Place, New Delhi-110066 for ready reference. It is alleged that the Central Pension Accounting Office sent the same to the Head Office of the Canara Bank on 18.10.2017 for onwards crediting the accrued revised pension in Account of Pensioner account No. 1762101003667 at Canara Bank, A-33, Ganesh Nagar, New Delhi-110018 but till date OP has not done. It was further alleged that the complainant personally visited OP several times and also wrote a letter on 08.01.2018 and sent e-mail on 16.01.2018 for requesting the revision of pension, but to no effect. Hence, the present complaint for direction to OP to pay the cost and penalty/compensation alongwith the interest.
After notice, none put in appearance on behalf of OP and was proceeded ex-parte vide order dated 09.07.2018.
When the complainant was asked to lead ex-parte evidence, he filed affidavit of evidence confirming the contents of the complaint on oath and relied upon copy of letters dated 21.09.2017,16.10.2017 & 08.01.2018 and copy of e-mail dated 16.01.2018.
During the course of arguments the complainant submitted at bar on 03.01.2019 that the arrear amount of revision pension has been credited by OP in the saving account of the complainant on 18.10.2017 and filed the Statement of Account and also prayed for the interest on the amount for the delayed period and compensation for harassment.
We have heard the complainant in person and gone through the material on record carefully and thoroughly.
From the perusal of the documents it reveals that the pension of the complainant was revised from 01.01.2016 and the Revision Authority for Central Civil Pensions, Govt. of India, New Delhi forwarded the PPO to OP on 16.10.2017. The statement of Account of the complainant reveals that the arrears were credited in the account of the complainant on 14.06.2018 after delay of approximately nine months. Therefore, there is deficiency on the part of OP.
Keeping in view above discussions and observation, we direct OP to pay a composite sum of Rs. 7,000/- towards interest, mental and physical harassment and litigation expenses within 45 days from the receipt of this order. In case of default of payment in time OP shall be liable to pay interest @ 6% p.a. from the date of filing of the complaint till actual realization.
