Ld. lawyer of complainant appears and submits the case. Upon considering his submissions and on careful scrutiny of the entire materials on record, it appears that complainant availed of treatment from o.p.  in respect of employee and employer relationship since no consideration money has been deposited for receiving treatment from o.ps.

            In view of the above, complainant cannot be termed as ‘consumer’ as per definition of the consumer as laid down in the C.P. Act, 1986, whereas the matter relates to employee and employer relationship and thus, this Forum is not competent to adjudicate the matter.

            In view of the above, the instant complaint petition is rejected for the reasons as stated above.

            Complainant is at liberty to agitate the issue on the self same cause of action before the competent Forum.
