In our view, the sum of Rs. 25,000/- deposited by the appeallant at the time of filing of the appeal, in terms of the 2nd Proviso to Section 15 of the Consumer Protection Act, 1986 can be refunded to the Respondent in the appeal that can only be as a part of the amount due under the decree/ final order. It cannot be as a bonus or punity damages or whatever to be paid by the unsuccessful party to the appeal in addition to the amount due on the decree/final order.

With the observations we proceed to dismiss this revision petition.
