Order Below Exhibit 1

 PER SHRI. S.M. RATNAKAR – HON’BLE  PRESIDENT

 1)        The Complainant and her Advocate are absent.  The Advocate Smt. Priyanka Chhabria i/b Ld.Advocate Crawford Bayley & Co. is present.  The Opposite Party No.2 is absent.

 2)        On perusal of record, it appears that the Complainant is absent since 24/05/2013.  The undertaking which was given by the Advocate for the Complainant Smt. Parikh that the Complainant is going to appoint Adv. Smt. Bindu Jain, on next date, is also not complied by the Complainant.  At the same time no steps have been taken by the Complainant as regards issuance of summons to the witnesses.  The Complainant appears to be negligent in this matter.  Today the Complainant is also served with  the  notice  by this Forum for today’s appearance, as well as the Advocate for the Opposite Party No.1 had also informed today’s date to the Complainant, however, the Complainant is absent. It appears that the Complainant is not interested to proceed with the complaint and therefore the complaint is dismissed in default of the complainant with no order as to cost.
