          The appellant is the opposite party/Finance company in CC.264/09 in the file of CDRF, Kollam.  The matter relates to the dispute regarding the amount claimed for redeeming the pledged gold ornaments.  The appellant was ex-parte before the Forum.  The complaint stands allowed.  The opposite party/appellant is under orders to return the gold ornaments after receiving the principal


amount Rs.40000/- with interest at 17% per annum and also to pay a sum of Rs.5000/- as compensation and cost of Rs.500/- as cost.

          2. The evidence adduced consisted of the testimony of PW1 and Exts.P1 and P2.

          3. The appellant/opposite party was ex-parte before the Forum.  The appellant has sought for remitting the matter.

          4. The respondent/complainant did not make appearance before this Commission. In the  circumstance and in view of the fact the order is not a considered one the same is set aside on condition that the opposite party/appellant pay a sum of Rs.7500/- to the complainant towards cost or depositing the same before the Forum which can be withdrawn by the complainant.  The Forum will  issue notice to the complainant and dispose of the matter afresh   after permitting the parties to adduce evidence if any.

          The matter stands posted before the Forum on 20.10.2010.

          Office will forward the copy of this order to the Forum urgently.
